Pathribal "Fake Encounter" Closed as evidence inconclusive Jammu, Jan 24: The Indian Army said Thursday it has closed the 2000 alleged Pathribal staged shooting case against its personnel as evidence collected by it did not establish a prima facie case against any of the accused. "Consequent to CBI investigation and order of the Supreme Court in March 2012, the army had taken over the alleged Pathribal case from the court of chief judicial magistrate, Srinagar in June 2012," said a defence statement issued here. "A comprehensive and exhaustive effort was undertaken to record evidence against all the accused persons. Over 50 witnesses have been examined including a large number of civilian witnesses, state government and police officials. "Forensic, documentary and other relevant evidence has also been taken on record. For the convenience of the next of kin of the deceased persons and other civilian witnesses, the team recording the evidence moved to the Valley to record their statements," it said "The evidence recorded could not establish a prima facie case against any of the accused persons, but clearly established that it was a joint operation by the police and the army based on specific intelligence," it said, adding: "The case has since been closed by the army authorities and intimation given to the court of judicial magistrate, Srinagar. The case related to killing of five people in Pathribal forest area of south Kashmir's Anantnag district on March 25, 2000 by security forces, who claimed all the slain were foreign militants killed in a gunfight and from whose possession weapons had been recovered. Following a public outcry that all the slain had been local civilians framed as foreign militants, the authorities had ordered exhumation of their bodies and subsequently ordered a Central Bureau of Investigation (CBI) probe into the incident. The CBI indicted five personnel of 7 Rajputana Rifles including Brigadier Ajay Saxena, Lt. Col. Brijinder Pratap Singh, Major Saurabh Sharma, Major Amit Saxena and Subedar Idrees Khan in the killings and described it as "cold blooded murder". In 2007, the CBI presented a charge sheet against the accused in the court of chief judicial magistrate, Srinagar. The army however moved the state high court on behalf of the five accused soldiers challenging the CBI's move, but the court dismissed the appeal. The army then filed a petition in the Supreme Court challenging the jurisdiction of the CBI to file a charge sheet against army personnel without sanction from the central government, contending they were protected by the Armed Forces Special Powers Act (AFSPA).

Killing civilians in the name of foreign militants and then giving killers clean chit is an ugly stain on the Indian democracy. This was stated by the chairman of Jammu Kashmir liberation front Mohammad Yasin Malik while speaking to media today. Yasin Malik said that on 26th march 2000 Indian army killed 5 innocents after abducting them from their houses and dubbed then as foreign militants who were involved in massacre of Sikh brethren at Chitisinghpora. The then state chief minister Farooq Abdullah and then home minister of India L K Advani wasted no time in hailing the efforts of their forces but after people’s protest against these killings, announced a probe and punishment for guilty. During the investigations even the samples of DNA were changed many a times but still it was proved beyond doubt that Indian forces had murdered innocents in cold blood for their petty gains and promotions and also for covering up the massacre of Sikh community at Chiti Singh Pora. Even the prime Indian investigation agency CBI in 2012 pleading before the Indian Supreme Court said “the alleged fake encounters at Pathribal in Jammu Kashmir 12 years ago in which seven people were killed by army personnel were cold–blooded murders and the accused officials deserved to be meted out exemplary punishment”. CBI senior counsel told the court no prior sanction was required for prosecuting the army officials and the need to ensure public confidence in the rule of law and dispensation of justice warranted their prosecution.” CBI told the court that “our investigations have revealed it was a fake encounter and cold blooded murders”. Yasin said now after 14 years we are being told that army has found no evidence of their involvement in the massacre and that army has closed this case. Yasin said that this denial and shielding killers ands murderers is not new as Indian army and rulers before this also shielded the killers and criminals involved in Gaw Kadal, Sopore, Handwara, Bijbihara, Kawdara, Tengpora ,Zakura, Bandipora, Poonch, Baderwah massacres and Kunan Poshpora like crimes. Yasin said that today Indian army has kicked out Indian democracy, law and even its highest court because these killers know that they are protected by black laws like AFSPA etc. Yasin said that the Indian politicians and their stooges in Kashmir (Pro-India parties ,leaders of Kashmir) are actually involved in these crimes as they provide the shields like PSA and AFSPA to these killer forces and whenever any crises arises try to defuse it by issuing orders and statements of probe and punishing the culprits. Yasin said that Indian occupation on Jammu Kashmir is because of these forces that is why they are being provided immunity to kill kashmiris at will .Yasin Malik said that kashmiri’s will not take this issue lightly and we will protest against this impunity with full force. Yasin announced that JKLF will protest against this criminal attitude of Indian state on Friday, 31st January 2014 at Lal Chowk. Meanwhile JKLF leaders and activists today after Friday prayers took out a protest march against giving clean chit to Pathribal killers. Led by zonal president Noor Mohammad kalwal, JKLF leaders Showkat Ahmad Bakhshi, Sheikh Abdul Rashid, Mushtaq Ajmal, Bashir Kashmiri, Mohammad Sideeq shah, Showkat Ahmad Dar, Mushtaq Ahmad and Gayas ud Din etc marched towards Lal Chowk with play cards in their hands against the killers. As this rally reached Budshah Chowk a large contingent of police stopped it from marching ahead. The participants sat on a peaceful sit in on the spot and staged a strong protest.
